The "New" Sony TOS

Post by Matty »

Just saw this on Twitter, thought it might be worth pointing out

http://www.sonyentertainmentnetwork.com ... ENT-EN.pdf

The TL;DR version

You cant sue them*, individually or in a class action lawsuit (Like the one for OtherOS thats ongoing) If you agree to use PSN you agree to this for life, even if you cancel your PSN/Other Sony service accounts

(*Them being Sony or any of its daughter/sister companies)
ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL LEGALACTION, UNLESS BOTH YOU AND THE SONY ENTITY WITH WHICH YOU HAVE A DISPUTE SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ARBITRATION. THIS PROVISION DOES NOT PRECLUDE YOUR PARTICIPATION AS A MEMBER IN A CLASS ACTION FILED ON OR BEFORE AUGUST 20, 2011.
Makes me glad i don't use PSN, If Credit card details ever go missing again & you get billed £1000's then you can't blame Sony & insurance wont pay out as you agreed to not hold Sony liable

Well it's a good thing I wasn't planning any high profile legal cases, however, I can't speak for any other members of the forums.

Maybe you aren't

But what if your Ps3 causes a house fire?
Your insurance wont pay out as you agreed not to hold Sony liable for anything

This is Sony covering their backs. They've clearly found a loophole in the original Terms of Service, so they've issued a new one to close it.

The bit you quoted clearly says that any case will be conducted on an individual basis. So you can't band together with a group of rogues and try to sue them collectively.

What Sony does is illegal in Belgium (and Holland for that matter). They simply can't state they are not responsible for their faults.

Class action lawsuits are big in the US and aren't for rogues

An example: The film Erin Brockovich

If one person was to sue the gas company they'd get off scott free, but seeing as lots of people clubbed together they couldn't escape
